Player Recieved Developer Item in Mail, One-Shots ulduar

"We first received a tip on a mysterious guild that was blowing through Ulduar's hardest achievements one after the other, all in one day, about a day or two ago. Their gear and raid experience stated very well that they were in no position to do any of those achievements, but we sort of shrugged and let it pass by. It was odd that these players were barely in Naxxramas gear, and their first recorded Kel'thuzad kill was only two weeks prior to their explosion of Ulduar achievements, but we initially ignored these reports because surely, nobody could be hacking the game. On top of that, the forum threads submitted to us all had so many posts deleted from them that they were completely incomprehensible. There was nothing solid about any of it."
To sum it up, a player named Karatechop recieved a developer item named Martin Fury in the mail, its use was to instantly kill everything withing 30 yards, and instead of returning it rightfully, decided to use it to help gear himself and his guild by subsequently destroying all end game content.
So i gotta ask, is it blizzards fault, or should this guy and his guild be banned? In other words, would you have done the same?

It states a guildie received it in the mail, and gave it to Karatechop (as its not soulbound). He then says he used it for fun, not intending to do worlds first achievements or get phat loot. the item has 100 charges, suggesting to Karatechop it was a temporary "gift" from the GMs. All guildies that were online at the time of the incidents, are suspended, and Karatechop is permabanned.

He's yet to be banned and he still has the item as well. Blizzard Entertainment- Working as Intended Since 1957.
To answer your question, I'd say its both parties fault, but at the end of the day the blame rests on Blizzard. Their systems should be better equipped to prevent things such as this. The dudes name is Karatechop and he's a Gnome warrior on US realms, it doesn't surprise me that he abused it. I can't say I'd do the same simply because I have no desire to get banned, but at the same time I can't fault him for using it. He was given the ability to 1 shot everything within 30 yards, most people would abuse it I think.
Also, I think both he and everyone who participated in the kills should be banned as well.
Edit- He and his entire guild have been banned.

why had blizzard to bann him because he used a item They sended to him?=/ i self wouldnt resist to get the power to one shot everything. they sended it to him.

Blizzard should at a minimum delete the item from his inventory. If it isn't available to any other player, it shouldn't be available to him.

Hmm, this is an interesting situation. I can't say that I won't use the item... its a moral issue I suppose. However, all the fault lies on Blizzard... not Karatechop and the guild he's involved in. In the end, I agree that all of his achievements and gear (in regards to his usage of the item) be taken away and be restored to his original state before he actually got the item.
And finally, with the time that he lost while one-shotting everything... I guess we could give him a few gold or let him/her keep one piece of gear to compensate for the time. It's just a thought...

The title by WoWInsider is misleading, they do not know it is a developer/gm mistake or something malicious by the player. If they get banned, it is probably malicious. If they don't, it was probably a mistake.

What would you do if you found someone's wallet, complete with ID containing the owners name, address etc, but the wallet also contained $5,000? Would you spend the money and ditch the wallet? Would you return the wallet? Would you spend the money but return the wallet and say that it was empty when you found it? Would you spend the money and return the wallet anonymously? Let me ask you this then... What would you do with the wallet and it's contents if you knew that someone of authority was watching your every move? That's what I thought...

I would keep the item and never use it, although I wonder what kind of reward if any they would have gave him if he returned it as soon as he realized the error.

bliz is on the side of error here its not like NPCs dont sent you mail, infact they always send you mail its even slightly plausible that they send an artifeact since epics come in the mail aswell.
There is a huge difference between being sent an epic item in the mail (which I don't think actually happens, excepting certain achievement mounts and GM reimbusement), and being sent an artifact for which
absolutely no comparable item exists
(it's a shirt item with +mana and strength), whose use effect explicitly states
"Cheater."
and using that item.
That said, depending on how culpable this individual and his guild is, banning the entire guild is probably a bit too much. Only if the entire guild was culpable (because they are a group of disgruntled ex-Blizzard employees who abused their access) should the guild be banned. If only the individual is responsible (for being friends with the GM, or for somehow hacking the servers himself and acquiring the item that way), then the individual should be banned. If the individual acquired the item by random chance (because a disgruntled GM sent it to a random individual), then he and any participating members should simply have their characters rolled back two weeks, to whatever time before they started using the item.

Not long after the Burning Crusade was released, I found myself in Hellfire with a bug that was instantly replenishing any mana I had used. I could pretty much spam heals on myself, the mana would be completely replenished in between each cast.
I had infinite mana, but instead of immediately forming a group for some easy instance runs, I reported it. It was obviously not something I was supposed to have, and if I had taken better advantage of it, I would not be surprised or upset if I was banned.
Certainly, it is Blizzard's responsibility to investigate and fix whatever allowed the iten to fall into the hands of the player, but Karatechop and Co. definitely deserve their bans for taking advantage of something they were obviously not meant to have.
